UPDATE 2: Yandex does everything to respect court move watchdog

MOSCOW, Aug 31 (PRIME) -- A full check conducted by the Russian communications service of Yandex has showed that the Internet company implements all the measures to follow the courts decision to cut access to illegally distributed video content of local Gazprom-Media Holding, the authoritys Deputy Director Vadim Subbotin said on Friday.

Weve just completed full scrutiny and weve interacted with all the parties. Were in constant contact with people from the both parties: Yandex and Gazprom-Media. As of today, we register that Yandex implements all the steps to execute the decision of the Moscow City Court on interim measures to protect the rights owned by Gazprom-Media and requirements of the communications service, Subbotin said.

At the moment, the watchdog does not plan to block Yandex services.

The communications service gave Yandex time until Friday to follow the decision of the Moscow City Court that ordered to take interim measures and stop illegal distribution of several series and a show of Gazprom-Media Holdings four TV channels. In case of misconduct, the authority could block Yandex.Video, which, in its turn, could entail problems for yandex.ru.

We find it reasonable and more effective that disputes related to distribution of pirated content by Yandexs resources should be further settled on the basis of self-regulation and mutual agreementsWe confirm our readiness to act as a coordinating party in establishing a dialogue between copyright holders and Yandex, Subbotin said.

A spokesperson for Gazprom-Media Holding said, Yandex does its best to execute the courts decision, this is why the communications services is not blocking it. Weve always been for the constructive dialogue format, but it does not cancel the submission of lawsuits.

The spokesperson referred to the four lawsuits filed by Gazprom-Media Holdings four channels TNT, TB-3, 2X2, and Super on which the court had taken interim measures.

Industry union hopes for dialogue

The Media-Communication Union, a local industry association of biggest media and telecom companies, thinks that all distributors of content should act within the legal framework, and the tools distinguishing legal content from pirated one are successfully applied by western search engines.

The companies working in the Internet should not exploit their position to discriminate market participants, otherwise we may find ourselves amid a legal outrage, a union spokesperson said.

The union is concerned about Yandexs earlier statement of its inability to separate disputed content from legal one.

There are tools making it possible to delete illegal content. And other players of the market, including Google, successfully apply them. We hope Yandex and copyright holders would establish a constructive dialogue, which will erase pirated content in search results. Were sure it will create stimuli to development of Yandex itself and its video service, the spokesperson said.
